These Terms of Service ("Terms") govern your use of ForgeBox ("the Service"), operated by FuseBox Online CC ("we", "us", "our"), a company registered in South Africa.
By accessing or using ForgeBox, you agree to be bound by these Terms.
1. The Service
ForgeBox is a cloud-based HR management platform that enables businesses to manage staff onboarding, offboarding, leave, contracts, training and integrations with third-party tools.
2. Accounts and access
2.1 You must provide accurate and complete information when creating an account.
2.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
2.3 You must notify us immediately at support@forgebox.net if you suspect unauthorised access to your account.
2.4 We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscriptions and billing
3.1 ForgeBox is offered on a subscription basis. Pricing is displayed at forgebox.net and on your billing page.
3.2 Subscriptions are billed monthly or annually in South African Rand (ZAR) via PayFast.
3.3 Your subscription renews automatically at the end of each billing period unless cancelled before the renewal date.
3.4 You may upgrade your plan at any time. Upgrades take effect immediately.
3.5 You may downgrade your plan at any time. Downgrades take effect at the end of your current billing period. You retain access to your current plan features until then.
3.6 A 14-day free trial is offered to new accounts. No payment is required during the trial period. At the end of the trial, a subscription is required to continue using the Service.
4. Refunds
4.1 Please refer to our Refund Policy for full details.
4.2 We do not offer refunds for partial billing periods.
4.3 Annual subscriptions may be eligible for a pro-rata refund within 30 days of payment. See our Refund Policy for details.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Upload or transmit any content that is harmful, offensive, defamatory or infringes the rights of others.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Use the Service to store or process data in violation of applicable privacy laws including the Protection of Personal Information Act 4 of 2013 (POPIA).
- Reverse engineer, decompile or attempt to extract the source code of the Service.
- Resell or sublicense access to the Service without our written consent.
6. Data and privacy
6.1 You retain ownership of all data you upload or create in ForgeBox ("Your Data").
6.2 We process Your Data only as necessary to provide the Service and as described in our Privacy Policy.
6.3 You are responsible for ensuring that you have the necessary rights and consents to upload personal information about your employees to ForgeBox.
6.4 We implement appropriate technical and organisational measures to protect Your Data in accordance with POPIA and applicable data protection laws.
7. Integrations
7.1 ForgeBox integrates with third-party platforms including Microsoft 365, Slack, GitHub and others ("Third-Party Services").
7.2 Your use of Third-Party Services is governed by their respective terms of service. We are not responsible for the availability, accuracy or conduct of any Third-Party Service.
7.3 You are responsible for providing accurate credentials for Third-Party Services and for ensuring you have the necessary permissions to provision and deprovision accounts on those platforms.
8. Intellectual property
8.1 ForgeBox and all associated software, designs, trademarks and content are the intellectual property of FuseBox Online CC.
8.2 We grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes during your subscription.
9. Service availability
9.1 We aim to provide the Service with high availability but do not guarantee uninterrupted access.
9.2 We may perform scheduled maintenance that temporarily affects availability. We will provide reasonable advance notice where possible.
9.3 We are not liable for any losses arising from service interruptions beyond our reasonable control.
10. Limitation of liability
10.1 To the maximum extent permitted by applicable law, FuseBox Online CC shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service.
10.2 Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount paid by you to us in the three months preceding the claim.
11. Termination
11.1 You may cancel your subscription at any time via your billing settings. Access continues until the end of your current billing period.
11.2 We may suspend or terminate your access if you breach these Terms, with or without notice depending on the severity.
11.3 On termination, your data is retained for 30 days after which it is permanently deleted. You may request a data export before termination.
12. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
13. Changes to these Terms
We may update these Terms from time to time. We will notify you by email and by displaying a notice in the Service at least 14 days before changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
